In the entrepreneurial world, the power of claims in marketing and advertising is undeniable. Yet, this power, if wielded carelessly, can be a double-edged sword. Just this past year or so, fitness influencer Brittany Dawn Davis was charged with deceptive claims in connection with selling personalized workout plans and has settled for millions of dollars.  She's been dubbed a "fraud" and her brand tarnished.  She was charged by the FTC and the Texas State Attorney and this is just the beginning.  Additionally, other influencers like the Liver King, who claim to live a natural ancestral lifestyle was exposed and he's been sued in a class action for deceptive claims in connection with his brand as it was discovered that he used lots of steroids.  

These two cases are just a couple examples of how claims fraud comes into play in this new age of digital entrepreneurs.

To really be successful as an entrepreneur, you need to understand advertising "best practices,", basically, the do's and don'ts, including but not limited to advertising laws, claims, endorsements, fraud, testimonials, content manufacturing/publishing and marketing.  Not only do you need to understand these concepts, frankly, you should master them as well, if not better than an attorney because this will impact your day to day business operations and cause you so much liability if you neglect.

Empowering Entrepreneurs with Legal Knowledge

The best way to defend against advertising violations is first to fully understand the legal landscape and the laws and regulations that govern and which we touched upon.  Secondly, it is then to create a defense system to implement into your existing business that is comprised of legal strategies, contracts, manuals and SOP's all designed to prevent problems and liabilities. 

Remember, every entrepreneur has the same 5 enemies and makes the same 101 deadly mistakes.  A business defense system, at least one built properly by an experienced lawyer, will enable you to identify your enemies and mistakes and deter them, while paving a path towards success.  

Too many entrepreneurs focus on their business plan and often neglect business defense which is usually their downfall.
